Authenticity Guarantee Policy
​
Luxe Junky provides an Authenticity Guarantee to the Buyer, subject to the following terms and conditions:
The Authenticity Guarantee is provided for a period of five years after the date of purchase except as otherwise provided below:

(1) The Authenticity Guarantee is provided solely for the benefit of the Buyer and cannot be transferred to any third party.

(2) To claim under the Authenticity Guarantee, the Buyer must: (i) notify us in writing on the earlier of (A) a period of three months after receiving any information that causes the Buyer to question the authenticity of the Item (B) the expiry of the applicable Guarantee Period, in each case, specifying the Invoice number and the date of the sale in which it was purchased, and providing the original Invoice and all the information in the Buyer’s possession in support of the Buyer’s claim; and (ii) return the Item, box, dust bag, and all accessories, at Buyer's expense, for review to Luxe Junky or, at our direction, to the Seller or another third party, in the same condition as at the date of sale to the Buyer and be able to transfer good title of the Item, free from any third-party interest or claim(s) arising after the date of the sale. In addition, we may also require the Buyer, at the Buyer’s expense, to obtain the reports of two independent and established third-party authenticators in the field that are mutually acceptable to Luxe Junky and the Buyer. Luxe Junky reserves the right to seek additional expert advice at Luxe Junky's expense.

(3) Luxe Junky reserves, in our absolute discretion, the right to reject a claim under the Authenticity Guarantee Policy if: (i) the Item description was in accordance with the opinions of scholars, experts and established third-party Authenticators, which are generally accepted and were known or expressed to Luxe Junky, as at the date of the sale. (ii) the Item sent to Luxe Junky by Buyer for review is not the original Item that was sold to the Buyer (iii) the manner in which the Item is said to be a counterfeit is due only to damage, restoration, modification work of any kind (including repainting or over-painting), treatment of gemstones, or damages to labels comprised in the Item present at the time of the sale.

(4) Luxe Junky reserves the right to send the Item, at Buyer's expense, to the Hermès Spa (Hermès after-sales services) for Item authentication purposes. In the event that the Hermès Spa will not service the Item because the Item is not in "serviceable condition" (for example: the item does not show enough wear and tear to warrant Hermés accepting the item) will not warrant a refund. However, in the event that Hermès confirms the Item to be unauthentic and will not accept the item due to the Item being unauthentic, this will warrant a 100% refund of the Purchase Price.

(5) Subject to the above, if we reasonably determine that the Item is a counterfeit, Luxe Junky will ensure that the sale is rescinded, and that the Buyer is refunded the Purchase Price in the currency of the sale.

(6) The rescission of the sale and the refund of the Purchase Price is the Buyer’s sole remedy available under the Authenticity Guarantee and is in lieu of any other remedy that might otherwise be available to the Buyer as a matter of law or in equity.
